Assault and Battery questions?

Ok, I have a court date today. I have a subpoena to be a court. I am the victim. Let me give the story as quick as I can.

I was at a friends apartment. UNKNOWINGLY to me, my g/f was outside, and was talking bad to a girl or guy about him cheating on her sister. Ok, I swear I didn't know this was going on. I was inside drinking a beer, probably my 3rd one.

I step outside to smoke a cigarette. The small argument had already subsided, but I never knew it even happened. The guy (whom I somewhat know, but never really had but one conversation with him) said something to me. I didn't hear him. I start walking to talk to him. No idea he was mad.

We meet halfway on some steps, and he is standing 2 steps above me and says "I'm going to hit you". I completely thought he was joking. I was like "What, man?" He said it again. I said "What's wrong, we are friends." This is really how it happened. I still wasn't sure he was even mad. He pushed me once, I held my hand up to shake and he pushed me again harder, I grabbed for the rail, and as I was coming back up he started punching my head/face. He immediately ran off somewhere, and my friend lead me back into the apartment and helped me stop my nose from bleeding.

Well, someone called the cops, that guy had done left (to go get his brother to fight me, CRAZY, I know). The cop told me to go to the hospital. I said I couldn't afford to. He said the guy that hit me would have to pay. So I go. I have never experienced this before. Little did I know that I would get the bills and have to get my money back somehow.

Well, tomorrow is my court date for this. What am I looking at, what do I need to say? Is he going to get put on probation? If so, would he have to pay my bills through probation or restitution?

What about witnesses? My court day is today, and there was a couple of people who witnessed this, but after the incident, the cops never got any more information. Do they need to be there? Or will their statements be recorded?

Could he actually not be found guilty?

    You will be asked by the judge to give your recollection of what happened. Simply tell the truth.

    As for the medical bills, never take the word of a police officer as it relates to court matters. In most cases they have not gone to any ind of school. The truth is that if the judge finds the guy guilty, he may require to pay for restitution. Take your medical bills with you to show to the court. Also take any other expenses you encountered as a result of the altercation. Again, this is contingent on the judge finding the other guy guilty.

    The judge may also hand down a punishment that does not include him paying you back. In that case, you will have to file a suit with the local magistrate to get reimbursed. That can take a while. Know this, the bills are still your problem to pay initially. They will affect your credit, not his. You will be the one the hospital calls and harasses to get paid. The other guy can only be required to pay you back. If he is broke, then it might be a long battle and you might never get the money back.

    As far as witnesses go, if they did not see the incident happen then how can they testify to it? All you can do is tell the judge your side of the story. And tell the truth. Take any bills with you and request that he pay for them.

    See if you can obtain a copy of the police report to take with you.

    Not necessarily will the judge have it.

    If you can't get one, take a witness with you to court who can verify the incident.
