Can my employer force me to ride in a rental car with someone who smokes heavily & won't roll down the window?

I just got a job where I have to travel a lot. A coworker who has been there a long time and is an chain smoker recently told me that I MUST deal with her smoking in the car and refuses to refrain from smoking even though I told her smoke gives me debilitating migraines. Right now we have seperate cars because we came from different locations, however my boss told me in the future I may have to share a rental car with coworkers. Can my boss force me to ride with her? Or is my boss required to at least get me my own rental car if he won't force her to refrain from smoking? Are there any laws that protect me or should i just find another job if I cannot get support from my employer?

Additionally, if you cannot add to the answer but rather would show your a$$ like "Dumb-*** can dance" then don't answer. This is a serious question. Thanks to though who are intelligent enough to shed a real thoughtful opinion.

    This is interesting. Your best bet is to speak with someone in HR. The laws in your state may differ from other states.

    If you can prove that second hand smoke is hazardous to your health (doctor's note), then your employer will have to accommodate you. They would either have to allow separate cars or force the coworker not to smoke in the car (or have her drive her own car at her own expense).

    Anyone who doesn't have the kindness to stop smoking for the sake of another, especially in this case, is a douche. I'd try to stick with it and bring it up to the employer, but if not, I'd grab the pack of smokes, break them, and then throw them out the ******* car window. Tell the slob to brush their teeth, stop relying on cigarettes to deal with stress, and try to search for a new job if this is not working out well.
