Person wrote a check that bounced?

I tried cashing a check that later bounced back. Is the person that wrote the check breaking any specific law, and if so what is it or you can just explain it.

Who would I contact if the check-writer refuses to pay the amount after I contact them?

thanks for your help!

yes, it is breaking a law!

Hand the check over to your county sheriff's department. They will serve them a letter requiring them to pay along with a court date if they want to fight it. They will be required to pay court cost. It is your responsibility to contact the court if they pay beforehand.

Yes, it is unlawful to write a check if there are not enough funds to cover it.

I would try this before going to the authorities.

Call the bank named on the check. Tell them that you have a check for $xxxx from account number yyyyyyyy. Ask if there are enough funds in the accouct to cover this amount. They will only tell you yes or no, they will not tell you exactly how much is in there.

If the bank is local, go directly to that bank and cash the check. You will have your money and be out only whatever your bank charged you for the innufficient funds fee.

Writing bad checks is against the law, but you will have a hard time charging them. If the person owns a home you can put a lien on their home for the amount due to you. This means, if they try to sell their house or refinance, they must pay you off first.

It's called check fraud. He wrote a check when there were no funds to cover it. It's the same as stealing.

Contact the sherrifs office in the city he lives in and ask how you can file a complaint agains this person for check fraud. They will help you with this.

Call your county attorneys office. I had this happen once and they sent the person a letter giving them so much time to pay. Most will pay if your local office offers this service.
