How is marriage defined?

I will be expanding on this question as answers arise. But for a start, what is the definition of marriage?

Update:

If I were the judge and you are a lawyer, and this question came up, how would you convince me to pick your side's definition.

Update 2:

The Constitution does not actually mention marriage at all, gay or straight.

So legally speaking, if I were the judge would you be asking me to say that all marriages are illegal?

Should straight married couples give up all the civil benefits that come with being married, including tax benefits and the right to decide what happens to their loved one in case of accident or death?

Update 3:

Why is marriage between a man and a woman only?

Again, remember that I am trying to get in the mind of a judge who may have to handle a case like this. Therefore, the Bible cannot be used as justification for man and woman only, because a real judge would not be able to use the Bible as part of his ruling.

Legally (Constitution, precedent, and law only), why is marriage only between a man and a woman?

Update 4:

One has now brought up the issue of children.

I am assuming that he means that the only reason for marriage is to continue the species.

Therefore, am I to assume that any straight person who is incapable of having children (sterile) should be legally required to stay single?

What about marriages in which both parties were able to have children at one time, but one or both no longer can? Is their marriage anulled at that point?

    Marriage is a religious ceremony. It does not belong anywhere except inside of a religious entity. The law should only be interested in the legal contracts instituted between adults who wish to share property and responsibility. No extra money should be afforded anyone for this religious right. No tax benefits should be given for this religious right. It should only exist in the vacuum in which it was created. No extension should be afforded for it's protection or solvency.

    Edit: Forcing someone to give up something they should not have to begin with is not the court's problem. The reality is that laws have been written to protect the child from the illegitimacy of bastardy. The extra incentives should be rescinded.

    Marriage is a Biblical institution, a covenant between a man and a woman before God. The Bible is the first record of marriage, thousands of years old.

    "For this reason a man shall leave his father and his mother, and be joined to his wife; and they shall become one flesh." Genesis 2:24

    Why do people who don't like the Bible want to marry. Why aren't they satisfied with carrying on with their own ways?

    People are offended by the truth, so they attack.

    By my dictionary, the formal union of a man and a woman, typically recognized by law, by which they become husband and wife.

    I don't like the idea of 3% of the population intimidating the other 97% of the population into surrendering their most ancient and sacred tradition. That's why I'm in favor of keeping marriage the way it is. Just not big on appeasement.

    Marriage is the union of two of something. People, things some kind of noun to make a single unit.
