I was ripped off by a company in CA, and I live in New York. What actions can I take to file a crime report?

After recently graduating from esthetics school (spa, facials, ect.) I bought spa equipment from a company called ree've lab out of CA when they were at the beauty/esthetics conference at the Javits Center in NYC earlier this year. At the Beauty show you get a lot of good deals, and so as a business investment, I purchased $1100 for all of the equipment for an entire spa room. Barely any of the numbers for this company work, and now when I finally find a working number and get someone on the phone, it's actually the owner, stating his name, but not his position as the owner (he was acting like an underling and like he had to go through different departments to get me my equipment, but in reality, and after researching, I found out there are only four employees and he's the owner). After weeks of me calling this man everyday, finally, he claimed the paperwork was done and he said everything was in motion to get my equipment shipped, and that he would call me the next day with a freight number and never did. This BS went on for a few months. Every time I call, he gives me an excuse and the run around saying it's on it way, but it never is. I have to block my number for him to answer my calls. Now he is still answering the phone at Ree've Lab, with just his name, but after all of this, he's now telling me that Ree've Lab went out of business and that he's working for and they're operating under a new company, and that they don't have to honor my sale anymore. I HATE TALKING TO HIM. He is mean, deceitful, and I have caught him in so many lies. I want to take legal action even though I don't have money for a lawyer. If I am in New York and the company was in Ca, what can I do? I know I should file a crime report of some kind, but I don't know where to start. I spent over a thousand dollars total (I don't really even have the money-it was more of me buying the equipment as a business investment- I used my savings that as a student took me a while to save). I have a receipt and everything that I would need to prove I bought it from them. I already contacted the administrators from the esthetics and cosmetology conference in New York to tell the the story. If I google his name there are millions of complaints. I don't know how he keeps getting away with it. I guess it's easy to prey on people at trade shows, because we automatically think it's safe to buy from a company at one of these events, but it's not and I don't want this stress happening to others! I have been losing sleep over this. Any suggestions would be appreciated. Thanks for taking the time to read this.

This is a civil matter, not a criminal matter. You need to file a small claims type of action in your state if you want any remedy at at. I don't know if NY has a small claims statute so you may have to take it to the municipal court. I recommend that you do this case "In Pro Per" meaning that you represent yourself rather than spend money on an attorney because these people will never come out to NY to defend themselves on such a small matter and you can win by default if you do this properly. You can get great books from No lo Press about representing yourself in court which will walk you through the process A-Z. You will need to perfect service on them and you can do this by highering a professional service company who do cross border service or you can have a third party send service via registered mail to them and this is also find.

Good luck but this is going no where criminally and it will stay civil. I hope that you win and that you feel better in the end when all of this is over with.

You should contact your attorney general of the state you live in, because even though it may have not happened in your state they can still take action against whoever ripped you off. Please contact your attorney general!
