Working 42-50 hours a week but still considered only part-time and no benefits?

Hi, i work at a Dillions Grocery Store and im one of thier Night-time stockers. Ive been working there for nearly 5 months now and i log over 42-50 hours a week, sometimes going as high as 60 hours a week. Yet i have yet to get a raise, and and get no benefits due to the fact that they say i'm a part-time employee. None of my family nor friends can figure out how a company can work employees over 40 hours and still give them no benefits and consider them full-time empolyee's. Anyone have any idea how they can do this or if im being screwed over by a scamming rutheless corp.?

    if they consider you to be an independent contractor then Yes they don't have to give you a raise or benefits. however it seems like your been taken.

    You aren't being scammed. There is no legal definition of full time or part time, and no legal requirement for a company to give benefits to an employee even if the company DID call the employee "full time" - if the company does give benefits, they get to decide the requirements for getting them.

    It is typical to get a raise once a year, although in today's climate many people don't get that even. It would be unusual to get a raise within 5 months of starting a job.

    Some jobs are under a union contract that regulate pay and benefits - if you are, then talk to your union rep to see if you are being treated according to the contract.

    They do have to pay you time and a half, though, for hours over 40 you work in one week. And they are required to pay you at least the minimum wage.

    You have the right to find a different job and quit. Then they'll have to find someone to replace you who is willing to work for what they offer.

    The responders who tell you that they are breaking the law might be saying what you want to hear, but they don't know what they are talking about.

    Sounds like your employer is trying to avoid paying the high cost of benefits by working you full time hours at part time status. There are A LOT of companies that do that to their employees. Best thing for you to do is to talk to human resources. If that does not work, I would concider finding another job, a job where they will appreciate all your hard work and dedication.

    Does this company have a Human Resources group? If so ask them about it. Here's a statement I found according to the U.S. Depart of Labor "The Fair Labor Standards Act (FLSA) does not define full-time employment or part-time employment. This is a matter generally to be determined by the employer. Whether an employee is considered full-time or part-time does not change the application of the FLSA."

    no they can not work you over 30-35 hrs for part time if you work 40hrs over you are full time and if the full time offers benefits you are entittled to it,I would contact the better business bureu in your area and tell them this because it seems like they are playing you,If you signed paper work for part time you are part time and if you clock in that is proof on how many hrs you work and your pay stubs is proof,Do not let them get away with it act on this fast.Good Luck!

    If asking for a full time position gets you nowhere, you can just as easily contact your local labor board of the U.S. Department of Labor.

    They are breaking the law.
