Child Custody Question Help!?

Okay i have been taking care of my daughter for her whole life (almost 10 years). Her father was NEVER around. He started paying Child Support 2 years ago.

All of a sudden his new wife (which i didn't know, and honestly didn't care) contacts me on MYSPACE and says here's how you can contact us. ???

My question - He's now down south and i'm up north. Since we weren't married do i have full custody or do i have to go file for full custody? By him being married does the judge see it differently and may grant him some type of custody?

Idon't want them in her life. She is fine without empty promises and a jealous "wife??" The things she said in her notes to me made me assume this.

okay, i thought i had to worry because he's married and that may mean something to the judge.

    Yes, you have full custody of your daughter... And if he has not been around in the past ten years, and since he was not the one who contacted you... I would not worry about him trying to get any custody rights... Although if he did try, you would have to go to court and he would have to prove his case... Since he is the father and is paying child support the judge may grant him visits... And if he is the type of guy to give "empty promises" then that ruling can be turned around after a short time... It's always whats best for the child....

    I wouldn't allow any informal contact via myspace, facebook or anything. If he wants rights, make him get a lawyer and go through the courts. In a few years, when your daughter gets older, she may want to have some contact with him, and if she finds him on myspace or whatever, that would be within her rights to do so. Don't make it easy on him to get back into your daughter's life.

    if you have full custody he basically gave up all his rights as father

    He still is required to pay child support though i believe

    You better contact a laywer to be sure, him being married means nothing

    it doesn't matter if he is married or not - hes a deadbeat. plain and simple.

    she lives with you and has for her whole life, you have full primary custody. if he wants to start problems he can go to court for visitation. otherwise you dont have to let him see your daughter though.
