Sales of goods and refunds?

Ok, my partner purchased some boots yesterday from a store, she has worn them once and due to the fact they have no soles they are dangerously slippy, the fact she has fallen 3 times already doesnt bode well for a serious injury in the future. She has the reciept and tried to return them is she entitled to a refund for the fact of her own safety?

Serious answers only please.

Update:

She tried to return them, but they claimed that because they had been worn they can't do anything because it's the style of the shoe.

Surely this is just fobbing her off? surely you can't know what they are like to wear outdoors unless you wear them outdoors.

    Under the Sale of Goods Act she is entitled to a refund because the goods are "not fit for purpose". That is, she should be able to wear them outdoors without slipping over.

    The only way that the shop can get out of this obligation would be if they clearly stated that the shoes were not suitable for use a certain type of surface.

    Print a copy from the web page (see below) and take it to the shop. Your rights are very clear and they must satisfy you. Any attempt to fob you off must be reported to the Trading Standards Office (see your local Yellow Pages for nearest office).

    I've done this many times with awkward shopkeepers. They always know when they're beaten.

    if you live in the UK try the Office of Fair Trading website which will have information on the Sale of Goods Act. One of the criteria is fit for purpose etc.

    Speak to a manager! On the OFT website there is a telephone number which will offer succint advice.

    Why are you asking here instead of picking up the phone and asking THEM. Of course we all think she should but our opinions mean diddly.
