Tax question about injured spouse?
My husband owes 2,200 in back child support. I used the tax calculator on h&r block website and it says we would get 6100 back for a return. If i were to file an injured spouse form what portion would be mine and what would be his? he made 5,000 more then i did and we have 2 kids that are ours together. Or should we jus file and let them take the 2200?
would we still get our taxes back quick if we just let them take it? and by the way he has been paying for the past 2 yrs ontime every month. when his ex filed for it she went back from when they were born and lied about him helping her with those kids. he even lived there part of the time. but he has no proof so he cant do anything about it.

The main tax payer would be the injured spouse, so who were more taxes held out on? If I were you I would file and let them take it so he can get caught up, if you file the injured spouse claim and they give the money back he is still behind on child support and could go to jail which would probably cost more in the long run, pay it while you have it.

You would get the money back MUCH faster if you just let them take it and then you wouldn't need to worry about it any longer. I'm sure it would be a huge relief to have this behind you (him). Also, like someone else said, even if you do the injured spouse, it may still net you the same $4000 and that would take at least 12 weeks from the time you file.

You could do the injured spouse thing and legally allocate both kids to you and none to him, thereby getting most of they refund to you. But why don't you just file jointly without the injured spouse and let them take the child support. It still leaves you guys with almost $4000 and him with a clean slate and maybe even a little respect from his prior kids when they grow up knowing that their dad met his obligations to them instead of just saying goodbye because I want to trade your mommy in for another one so I can forget about you. Sorry to say it so roughly, but what else could they grow up thinking if he doesn't care enough to pay for their care like a court ordered him to.
If nothing else, if you don't do the injured spouse, you will get your refund back much, much quicker.

It relies upon on your state and besides the fact that if or not you're in a community sources state. once I filed an injured significant other declare in long island(not a community sources state) I had made the better volume of money and the sole took out what he owed in taxes and gave me the EIC and different credit in TX(community sources state) they chop up our refund precisely down the middle

I'd say let them take the money. There is no way to know what your portion of the refund would be without seeing your tax return and your tax forms.

Let them have the money.
It gets it over with.
You don't have to wait 14 weeks for your refund.
In all likelihood, your husband's share of the 6100 is more than $2200 anyway.
