If you are U.S. citizen or resident and are married, you can file as married filing jointly or married filing separately. You can file joint return even if your spouse is a foreign person and has never been to the U.S. Your spouse is never considered your dependent; file joint return.

You can claim your son if he is U.S. resident or lived with you in the U.S.

If your spouse and son do not have SSN, you will attach W7 (ITIN application) with your tax return.

    Congratulations, you are married.

If you are in the process of getting green cards/ssns, you should file as MFS now and then amend it to include them later, after you get the SSNs.

Your wife won't have a residency requirement. Your son will--though if he lived in the US continuously until 12/31, you can elect the first year choice.

Why? because I doubt you could instruct that you offered more beneficial than 0.5 of her help. no longer in effortless words is there an income try for adults, yet there's a help try besides. The state concepts and pupil loans all count number as assist you probably did not furnish.

Since they aren't considered US citizens, they aren't people that you can claim on your tax return.
