They tried to take the stove and caused a gas leak, and I could have lost my family and my house!!!! We had to pay 2600 for a restoration service to fix it. Theres still alot of work to be done.Our homeowners insurance policy has a 5000 deductible limit per occurance. They wanted us to pay for a percentage of the deductible too.the claim was filed on Nov 20, 2008 we havent recieved any offer letter no information We are keeping good notes.There is a statue of time limitation for a claim right???We are tired and disgusted and need help!!We feel we should not pay because it was the neighbors damage initially that led to ours

    If the neighbors were not negligent they do not owe you for your damage or your deductible.

    If their house was locked up and an unknown person broke into it - what did your neighbors do wrong? Nothing.

    You are a victim of the thief just as much as your neighbors are.

    You should pay your own deductible.

    Your neighbors do not owe it to you.

    You are liable. Since you chose to carry a high deductible on your insurance, you'll now have to pay it.

    For LIABILITY, the guy that did the dirty deed - the bad guy, the thief, is liable. He's responsible. If you don't know who that is, then YOU have to pay for the damage to your unit, and the neighbor has to pay for the damage to their unit.

    I don't know of any statute of limitations for claims against your own policy. The statute, would be suing someone else - it varies by state, but generally in most states, is 2 - 3 years. And if you sue your neighbor over this, you're going to LOSE, as they were not NEGLIGENT - they are a victim of this bad guy, as well.

    Not what you want to hear, sorry, but it's true.

    I agree with MSAD. This is no more your neighbors fault than it is yours.
