Can I get fired for filing a workman's comp claim?

    You cannot be fired for firing a claim-it could be considered retaliation. However if you claim stems from a safety violation than yes, you could be fired. The reason your employer would give you is that had you been obeying their safety regulations than you would not have gotten hurt. For example you could be terminated for getting an eye injury when you were not wearing safety goggles when should have been. Or if you were doing something foolish like playing "sword fight" with utility knives with your friend and you get a cut from it. Your employer could most certainly fire you for that behavior.

    Not for filing a claim, no.

    However, there are things you could be fired for.

    Just how did the accident occur? In the line of duty, or while doing something you should not have been doing.

    Did you report the accident immediately? This is a requirement of the law. The employer must be notified immediately. Now, obviously, if you hurt yourself and someone working near you helps you, this is notification. You still may have to file a formal report with a supervisor.. However, if, for example, on a Wednesday, you claim to have hurt your back last week, then you are not in compliance of the law.This is not immediate notification.

    In summary, the act of filing a comp claim should not result in your getting fired. However, violations of the law or company policy could result in disciplinary action, or termination.

    No they cannot fire you for filing a comp claim.

  • You wont get fired but you should find a new job, the people you work with will be hating life and talk about you behind your back, get the cash and run!!!!!!!!!!!

    You can't be fired for that reason. They'll just wait till your late one minute or some other BS reason.
