How can a restaurant get away with such treatment of workers?

My daughter has worked at a major chain restaurant for 3 years. She's experienced because she worked at other restaurants before that and she also bar tends. Her hourly wage is slightly over $2 an hour and has never had a raise. They often call mandatory meetings that can last up to 2 hours and they do not pay the employees.

The manager is hot tempered and verbally abusive at times. Yes she gets tips but they vary. Sometimes she does well, other nights her tips might only be $30 for the whole night.

This is a very popular steakhouse in Tennessee. It seems though that they believe in slave labor. I've seen my daughter go to work with a fever because she was afraid of management. While she was working sick, the boss said to her sarcastically, "What's the matter with you? You're looking sour tonight". She never told him she was sick.

Yes she could leave but as we all know, the job market is poor right now. She's got a car payment and pays for her son's preschool, so she can't afford to walk away.

Part of the point of this question is the fact the restaurant is doing this at all. Even if my daughter didn't work there, how can they get away with not paying employees for mandatory meetings?

I realize that in TN and probably some other states, the food industry allows different wages. However, slavery is supposed to be over.

In fairness, the other restaurants she worked at (also in TN), did pay for meetings and she has had some kind bosses.

    The Federal minimum wage for tipped employees is $2.13. The owner can choose to pay that in lieu of the standard minimum wage only as long as the tips make up the difference between the two. If they don't, he has to make up the difference. If the owner isn't doing that, she should file a complaint and a wage claim for the missing money. Given that waitstaff jobs are relatively easy to come by, perhaps it's time she look for a better job. If she's good at what she does, and as dedicated as you say, there's no reason she couldn't.

    They get away with it because no one reports it. I'm sure many complain to family and friends, but the authorities are not psychic

    Its a tough world and her options consist of quit or adjust.

    she can either talk to corporate or her regional manager or she just has to suck it up.
