How can I convince a family member to file for Bankrupcy?

I have a family member, she is older and owes a lot of money to credit card companies. I'm sure it is in the upper 5 digits. I worry about her ability to pay her bills, and she just lost her job, Honestly the only way I can see her being able to afford to keep her apartment is to file for bankruptcy. She doesn't own a lot of luxuries, she has a laptop, and a 13" tv and a car that is already 10 years old.

Every time I have mentioned it she gets very upset, She wants to pay off the bills but her circumstances just keep getting worse, she is paying them off slowly but the interest is killing her.

She is terrified she will lose everything if she files. And that everyone will know, and that she won't be able to get a job because of it. And that friends and family will find out and look down on her.

We are in Canada, is there a credit company that is actually able to help, she contacted one a few years ago but because she didn't own a home she was out of luck.

Your family members problem is not bankruptcy, it is money management. Until she learns this nothing will help her, NOTHING.

These credit companies will just make things a lot worse, trust me the easy way out always makes things much worse in these matters I 100% guarantee this.

She deserves what has happened to her it is her own fault, Until she can accept blame for her mistakes and be 100% faithful to her vows to never to make these mistakes again nothing you do will help. From now on until she dies she must never use loan sharks again, that is credit cards. If she cannot do this her situation will not improve even if all her debts were cleared she would just make the same mistakes again.

The fact is she already has lost everything through her own financial mismanagement. Her friends and family should look down on her especially if she does nothing to remedy this situation and stop spending money given to her buy loan sharks.

She needs to see a lawyer about this and look at her options, this is a must. Strategy is very important in your payment approach. For instance if you make larger payments they may drastically up the interest rates. Maybe make minimum payment at a negotiated lower interest rate then one day just drop 50 grand that she was saving on them and pay them off all at once. You need to talk to your lawyer about this. The credit card companies are out to screw you out of as much money as possible, I guarantee this.

Option one she sells herself as a slave. The fact is she already is a slave to debt and it is her fault. I am not joking about this. She can sell herself to you, She can sleep outside in a tent and be a servant to your family doing anything they ask when she is not working. She can also sell her body part time if she is good enough looking to be a hooker and make extra money this way. She must live a very minimal spartan lifestyle. All the extra money she makes goes to pay off the debt. You cringe at this? The fact is if she is unwilling to make major sacrifices on par with my suggestions she deserves her fate, and the shame she will feel will be deserved.

Option two is she not pay and never use credit again, always use cash. I don't think this will work because they can garnish her wages. She needs to talk to the lawyer about this one.

Not everyone has debt, I don't, I have a lot of money and I never ever go in debt on credit cards. I pay cash for everything including cars.

I don't know canada finance law but i'm sure if she has been making timely payments the credit companies should be able to work with her by lowering her interest rate. or they might have hardship clause where they won't charge her a late for for so many months until she can catch up if she has been late. She should and you shouldn't be ashamed of her debt. everyone has debt. imagine how good she'll feel when she pays it off.

    GOOD LUCK

doesn;t sound like she really has that much to lose - they don;t take your personal items

How will filing bankruptcy keep her from losing her apartment. Why would she be in danger of losing her apartment if she pays her rent?

If nothing else, she should pay her rent, food and utilities before paying any debt bills
