CT Workers Compensation Settlement Claims?

My father used to work as a D&A counselor at a CT prison. During the course of his work, he was injured and is unable to work any longer. His claim is undisputed by the State of Connecticut but hasn't been paid a settlement as he was told the State of Connecticut isn't paying settlements because they have no money, and its been over 12 years since he was injured. Does anyone know if this is true, that CT isn't paying workers comp settlements due to lack of money?

~~Seems as if all the states are broke. Nice that the Senate (some at least), do not want to help any of us by getting this stimulus bill passed!

It's probably true, they have no money, You may need to contact a Workman's Comp Attorney, if anything can be done, they will get it taken care of.

If he is no longer able to work, advise him to apply for SSDI. He will get some income again as well as Medicare benefits, if he is approved.~

Well if CT is a monopolistic state they should have money available to pay off claims. If the claim is still open than your father should be entitled to settlement. I'm not sure "lack of money" is an excuse.

Perhaps your father should speak with an attorney regarding settlement. The state should have a special compensation fund to address any possible settlement.

No one is EVER required to pay a settlement on workers comp. They can continue, at their option, to just keep paying medical bills and lost wages, as long as required in their state. MOST states, cut off benefits well before 12 years are up, as if you are fully disabled, you can go on SSDI well before that time.

You don't get "pain and suffering" settlements from workers comp.

I have the same problem, I have a case with L.A. county. It has been about six years and the case had not been settled. However he should apply for disability or go to social security. Tell him to have a second opinion with another lawyer or call Attorney Bar Association.
