Should I sue Wal-Mart for racist employee behavior?

While shopping at wal-mart, I was asked to count my items by the clerk not knowing i had been in the "20 items or less" lane. I didn't have but 23 items, after she had scanned everything she said we should have went in the regular lane. then she let two women from the long line with carts full to the brim (which were of her same race African-American) that they could come into her lane. We then proceeded to ask her why them and not us? she said she did not care. After contacting Wal-mart corporate, they told us the situation was handled and the reason she did it was because it was a matter of race (us being caucasian.) Should i pursue a judgment for compensation? They offered a 10$ gift card which we didn't accept.

    I would peruse this with an attorney. One thing I find incredible is that Walmart Corporate would admit the incident happened because of race. I can't believe this was a one time thing for this employee. Wonder if she has been "disciplined" for this before.

    You were right not to accept the $10 gift card. That was an attempt to "shut you up" with money. Money is not the issue here, neither should you make it into one by pursuing a judgment for compensation. Basically, you don't deserve compensation since you were not out any money because of the treatment you received. What you should want, however, is for the racist employee to be fired. That is the issue here . . . not money. Therefore, I would write a letter to Wal-Mart, telling them that unless that employee is fired, you are prepared to go public with your complaint and proceed with a legal suit against them and their employee for racial discrimination.

    How were you harmed by this?

    That employee is essentially immune from work-related rules. Unless you catch them on video committing a felony on the job, you CANNOT discipline an African-American in any way without putting your business at risk.

    Wanna' sue someone? Sue the employee personally, not WalMart. You might also want to sue the EEOC without which truly horrible employees like her would have to improve.

    Even if you weren't physically harmed, I think you can and should get away with it. Sue, man. Because if she was racist you will win. And Wal-Mart is known for their screw ups. They have a lot against them, so physical damage is not a necessity. You should go for it.

    this is so bogus---in so many ways!!!! but mainly---NO WAY WOULD WAL MART TO YOU THAT BECAUSE YOU COULD SUE THEM!!!! BOGUS CLAIM!!!!
