How much should my daughter be offered?
My 18 year old daughter was in a one car, roll over crash on Halloween. The girl that was driving is her college roommate and they are best friends. The roommate is fighting the C&I ticket she received as a result of the accident because she really believes (as do we) that the accident was just a freak accident that could not have been prevented.
My daughter had moderate injuries as did all four occupants of the car. Air bags saved their lives! They were all taken by ambulance to the hospital but they are all basically okay now.
My daughter hit her head and had to have stitches in the middle of her forehead. She had some severe bruises and aches and pains for a few days afterward and some anxiety when she got in a car again but she is basically fine now. She will have a small scar on her forehead that won't ever go away but it could have been so much worse and we are so thankful they all walked away.
So, we really don't want to hire a lawyer. Not only do we not want to sue the roommate, but we know the lawyer would get about half of any settlement she received from the roommates insurance company and we don't anticipate it being worth it to get a lawyer.
We are wondering what a fair settlement might be? We are in Missouri if that makes a difference. $1000? $5000? I really have no idea but my daughter's roommate got a call earlier this week saying they will let my daughter know soon what they are going to offer her.

Perhaps I should clarify I am not interested in just anyone off the streets' off the cuff comments. I was actually asking if anyone in the legal field that actually knows something could answer but thanks anyway.

More than that - at least cover the medical bills/insurance deductibles/etc.

I have been hit by two bad drivers in the last five years. I had all my medical bills paid and about 80% of my lost wages. I got nothing for pain and suffering. I was reimbursed for gas costs to the Doctors and for daycare cost while at the Doctors. Now in my case the other drivers were at fault and clearly in the wrong. I have heard of one girl who got 100,000$ for a scare on her face but I don't know how big the scare was. If this scare is noticeable and bothers your daughter hire a lawyer. Remember the lawyer will take 30% of what you collect. If she can live with the scare let it go. Make sure they pay her Hospital bills.
Aside from that If your daughter didn't have any lost wages you won't get much. I would think they will offer around 1,000 if there is no loss of wages.
I would like to address the people who think sewing insurance companies is wrong. I will NEVER be the same after my two crashes. I have had years of pain. Why? Because people have to drive like jerks. Nothing ever happens to these bad drivers and that isn't fair. Our only choice is to sew so shut up please. Until you get hammered by a bad driver you have no right to speak.
I agree with sgoldper. I find in hard to call any roll over a freak accident. Her friend was going too fast.

What was the hospital bill? You think it was a freak accident that couldn't have been prevented right? So then you should ask for the Hospital Bills to be covered. I realize your daughter had problems getting in a car at first afterward, but she's fine now so no real need to talk about pain and suffering. Perhaps you want a little extra over the hospital bills, fine. To me though we'd have to know the bills that YOU paid to say what settlement you should ask for.

First, the Bible does not say God condoned what Lot stated, simply studies what took situation. It does not say what Lot was once considering or his factors. Second, possibly he was once appearing in religion. He knew how Jehovah had stored Sarah while she was once taken into the loved ones of Pharaoh. God intervened and avoided Pharaoh from violating her. And because the truth that God's angels honestly DID intrude, then undoubtedly his religion was once good headquartered. Third, he can have been shopping a while. The institution of guys external his condominium have been homosexuals and would not have desired his daughters. Plus, they have been engaged to guys of the town, so household, peers, and industry buddies of his sons-in-regulation-to-be can have been a number of the crowd. Lot might have reasoned that a few of the ones guys within the crowd might talk up in safeguard of his daughters. It might possibly divide the mob and minimize the risk relatively. Have just a little religion.

Seriously, your daughter had minor injuries resulting from an accident that have left no permanent disability.
I would expect that your daughters hospital expenses are covered and that's it.

If u dont want to make waves just get the medical bills paid by the auto insurance, and take whatever they offer for pain and suffering.

you are being played.....insurance company wants nothing to do with your lawyer....and conveniently you don't want one.....lets play poker....simply ask the friend if she has spoken to the insurance company...the eyes are the windows to her soul.....what is her ''tell''

Enough to cover her medical expenses and any damages to her property.
An accident should not be considered a windfall.

Giving thanks to GOD that everyone ok have the scar removed and forget about suing
