If he died intestate (without a will) his estate will be handled according to AL state law.
The ex already got half through the divorce. She has no further claim to the remainder. Her children with him MAY have some right to part of the remaining half. The surviving spouse has at least a partial claim to the remaining half.
You need to consult with your OWN attorney on this. AL law generally gives the surviving spouse 50% of the estate of the decedent. The remaining 50% is divided evenly among all surviving children. If he has any deceased children their estate receives that child's proportional share to be divided among that child's heirs.

My husband of 33 years and I have lived in Alabama for 23 years. He made a will in the state of Iowa 40+ years ago leaving 1/3 of his estate to his spouse (he said she was not named), and 1/3 to each of 2 sons, He never made a new will. He is recently deceased. Is this 40 year old will, written in the state of Iowa still valid? I have never seen a copy of this old will.
