eviction problem help please?
ok i have an apartment house and my old house on my property. for months ago a guy said he would help me out around my greenhouses for a place to crash once in a while. My apartment house is full so i told him he could crash at my old house if he needed to. I never made p a lease for him because he wasnt a tenant he was just there a cople days a week. Now 4 months later he is living in there. I want this guy out. We have caught him on hidden camera breaking and entering my tenants apartments. Do i have to give this guy an eviction? Can i just go into my house and take his stuff out legally? The police are trying to find him but he runs whenever they come and they cant catch him. What are my options? please help this i s sincere
I live in hampton NY

first of all just tell him to leave and get back the keys. If he refuses, then go the eviction route, and chalk it up as experience.

READ up on AT Will tenancies in your state
He was NOT tenant, you never made a lease and permitted only occasional overnight use--crashing.
Send him letter noting that you wish him to turn in the keys and remove ALL of his property from your premises. Don't have to give reason. Give him 3 days. Mail this to him at any address, multiple addresses you have for him, including yours, and leave it for him at your place. Tell him in letter that you rescind any permission for his use of your property, that it was supposed to be only occasional. State that you will remove his property on X date if he has not done so by then. Box it up and put it where he can get it (for your protection), if he doesn't get it.
For your own protection, suggest you change ALL locks, for tenants and house.
