When does a free speech statement become treason?

The governor of the U.S. state of Texas has suggested it's time for Texans to secede from the Union. In a state where the majority of people carry guns, there are a few crazies who might actually start rioting and trying to build up momentum for secession. While, I believe in freedom of speech, I am not sure it's ethical or legal for an elected official to urge secession. Isn't that at least bordering on a act of treason?

    If what he is doing is illegal, I think it would be more closely characterized as "sedition".

    He hasn't threatened anyone, he hasn't taken up arms against the government, nor told anyone to do so.

    I would bet that if he is arrested, you can be all but certain that there will be repercussions. I think the Federal Government would be making a big mistake to pursue charges against him.

    Treason is defined in the US Constitution

    Article III, Section 3

    1. Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

    2. The Congress shall have Power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted.

    You would know this stuff if you bothered to READ THE CONSTITUTION.

    Texas can legally secede from the union. It was part of the agreement it made when it joined the United States.

    Seceding from the Union is not treason, and in fact, quite lawful and Constitutional, unless you can point to something in the Constitution proving otherwise.

    I'm not following your logic of why a state who became one of the united states is not free to leave the united states.

    Hardly that. Treason, in case you hadn't noticed, is the only crime specifically defined in the Constitution, with very strict limits on its meaning.
