Can Apple Customer Service do this to me?

I bought my iPhone 3G in Jan. of 09. My speakerphone went out on it a couple of weeks ago. I called Apple and they told me they would send me a replacement free of charge, if I sent back my old phone. Well turns out they charged me for the replacement phone. I called them to tell them to just fix my speaker on my old phone when they send my old one back. Well the guy told me they cant send it back because they already sent it back to their factory. So now they make me pay for the replacement and they took my old one which I paid for!! Can they do this?!?!

    no they can't! all new phones come with a minimum 12 months repair or replacement warranty.

    Yes, they can do that. According to APPLE service contract, APPLE will charge the whole unit price to the consumer if APPLE judge it is customer abused case.
