If courts use the "disparate impact" argument as was used against white males in New Haven?
is it a waste of time for those white men to even apply for a government position. If a minority doesn't score high it is ruled the test must be flawed. Who's to say that the minority didn't purposely score low?
Edit; Nostra..If you are suggesting that someone wouldn't be above "feigning" failure, think again. Not all would of course, but some would lower themselves. Be honest with yourself.

It almost sounds like the ? courts/liberals ? agree that minorities are incapable of scoring high on tests, so they need 'special preferences'. (like what you would give to special ed kids in school?). It is an insult for the minorities, its like saying they are too dumb to pass.

There is a good chance that the Supreme Court will overrule Judge Sotomayor's Appeals Court Ruling upholding this insanity. I hope that they do it in the midst of her vetting before the Senate.

yours is the first post that i have seen that actually makes the point that it was the entire court that made this decision and no single justice.
though it wasn't for any government position, it was for firefighters.

hiring someone or not hiring someone because of there race is bigotry...They should hire the best man for the job...Whoever passed those test should be the one with the promotion ....
