My apartment neighbors smoke...?

the biggest problem is it is the manager...and she is directly across the hall from us! The smell is coming under the door. It is horrible. I get headaches and my sinuses and lungs burn.

We just moved here a month ago, and I did not know she smoked. The only thing I see in our lease is that tenants must keep their home "free from objectional odors". I wish I could ask to move...but we just moved here! HELP!!!

Update:

Yes, we have a towel in front of the door and we do open the windows when possible...but so does she and it comes in our place too.

Thanks for the ideas though!

Too bad my health and my children's are suffering because of this...

Stuff a towel under the front door. It will help keep the smoke out. Open any windows you have when you can to help air the place out as well.

I like the towel idea, maybe you could add a few drops of perfume or whatever to the towel. Also open windows thad don't face the smokers apartment and maybe have a fan to circulate the air. Buy alot of air fresheners both the aerosol and plug in varieties.

Unfortunately for you and your health, the tenant has a right to smoke in her own apartment (unless it is a lease condition that she doesn't). As a former smoker, I would get pretty irate if someone asked me to not smoke in my own apartment- hence I don't think speaking to this lady would be a good idea. However, if she does smoke in common areas ie the hall, entrance way then you have a right to raise the issue with her. I used to have an apartment neighbour who preferred to keep his apartment smokefree and smoke in the hall outside his front door instead--

I believe your best course of action is to try some of the hints you have been given, as just raising the issue with the neighbour would not set you off for a good co-existing relationship (and neighbourly disputes can get nasty) . Good luck

I so hate smoking. We lived in a duplex next to two very heavy smokers. Our place smelled like smoke all the time. It was gross. Is it possible for you to talk with the owners to see about getting out of your lease. Smoking is definitely an objectionable odor to those of us who do not smoke, but unless it is a non smoking building you most likely can't do anything about anyone else smoking in their apartment. You might have no other option but to plan on moving as soon as your lease is up. You have my sympathy.

Did you not smell the smoke when you looked at the place? I have apartments that I rent out and I always ask if they are looking for smoking or non smoking. She should have done this for you. Does she own the apartments? If not then you might be able to get her to let you switch to another place. Ask her to get an air purifier to place in the hallway.

    This issue stinks!

    ruby jane,

you are not allowed to hurt others, your "RIGHTS" don't allow you to put others in a health hazard. This person has every right to take this matter to court.

Your first step would be to put in a formal complaint to the property manager. Sense your problem is with the property manager your next step would be to consult legal assistance.

It may just be easier to move, until then just block off where the smoke is coming from, like using a towel.

Remember, second hand smoke is deadly.

have you tried confronting these people face to face? letting them know your dilemma? creating a deal that can work for both you and them? you should be doing something about it. if you've tried everything and really can't deal with it, try finding another place or find ways to keep the smoke out of your apartment.

You could buy her a smokeless ash tray, it sucks the smoke away so very little escapes that would bring it way down.

    Nothing you can do sorry.

She is in her place, doing her own thing and you are in yours. She smokes you don't. Get over it.

l would say ...get over it.

People who smoke.... are entitled to smoke.

l am a non smoker....but heavens above, you cannot take peoples rights away from them.

God, are you whining or what!

Get over it, she can smoke in her own house.

If you don't like it, MOVE!
