Social Security Benefits?
My husband and I just found out that his son, who is 17, is receiving disability benefits and that his mother set him up for this. We know of no disabilities this child has with the exception of ADHD.
He will be 18 in December and graduating from high school next June. Our question is this. If he is still living at home and receiving these benefits, will my husband have to continue paying child support on him? Is this something he is required to pay for the rest of his life or while he is still just living at home? We were looking forward to not having this to pay when his son was old enough that we could stop. He has not seen his son in 10 years.

if the son is 18 then you do not have to pay child support, ADHD is considered a disability though, im on disability benefits for having really bad asthma to where i can barely walk up stairs and do normal things, my brother actually has disablilty benefits for ADHD. Having disability benefits through social security does not effect child support whatsoever, they are 2 different things

Oh you can get her in big trouble for this! If he's on disability, you shouldn't have had to keep paying child support! Why hasn't he seen his own Son in 10 years? Don't tell me it's because of her, she can't keep the boy from his Father unless his Father was to lazy or didn't care enough to see his own Son! I'd be turning her in and why would YOU want to be with a man that doesn't care enough about his own Son to be in his life?

ADHD is a qualified condition to receive those benefits. Disability payments in no way affect child support payment responsibility.

I am not really familiar with these laws, but i always thought that if the child is 18 years old and has his own income (social benefits are an income) you dont have to pay for him anymore.
