Will the insurance company revoke payout for pain and suffering if...?
I got in a somewhat serious car accident a few weeks ago. I hit a parked car, but didn't do anything wrong, so I wasn't cited. My car was totaled (it was a pretty inexpensive car), and I had a sprained wrist. My passenger had her foot up on my dashboard (possibly out the window on my side mirror, not sure) and had a cut on her leg, and that was all. We both went to the ER for X-rays and such, and are now both fine. My insurance company paid for all of both of our bills, and she didn't pay a cent. They even gave her a check for $300 dollars for pain and suffering. She's a minor, and she and her family have signed the settlement. However, now she's been verbally abusing and harassing me (I have some proof of this in texts), and lying about many things, including what happened in the accident. If I tell this to the insurance company, will anything happen? and if so, what? I have been as calm and collected through her harassment as possible. Is my only way of pursing action against her to tell the police and consider a restraining order or pressing charges?

You hit a parked car. That IS doing something wrong. You just didn't get cited. That accident is STILL your fault.
No, if you tell this to your insurance company, they aren't going to do anything. Pain & suffering doesn't get revoked. It's FINAL.
You file charges against her with the police, and get the restraining order. It's a seperate matter.
