My bf and I are having problems everytime we argue he wants me to leave and he takes my car away.?

We always argue and I go back and forth to my sis house when we get mad at each other. Thing is he got me a car and when I try to leave he takes the key saying leave its his.. The loan used to by the accord is in his name only and the car is registered to me as the owner and him as the co owner. It is also registered to my address. Can he take it away from me legally being that he is only the co owner?

BTW I make the payments, never missed one and been on time all the time.

    call the cops...show them your papers and leave with the car! then settle his claim by buying up the loan or allow him to buy full ownership.

    No he can't. Since he is only the co-owner, he would need your permission to take it away from you. You can't do anything to the car legally without consent of the owner and co-owner. Since you are the owner than you should have the final say in anything concerning the car. Once the papers were signed to say that you are the owner than you own the car. If you agreed to repay him or if their was some kind of compensation for the loan, this is called Accord and Satisfaction which is a legally binding agreement. He is paying for the car and you get to own it. He made the mistake in whatever agreement you made in paying for it and give you the title. Hope this helps.

    Since you are both owners (primary and co-owner) the care belongs to both of you. No he cannot legally take the car from you. He would need to sign for you to get full ownership or to sell the vehicle. In addition, you would need to sign for him to do either of those things too. You could take him to small claims court to get full ownership or try to pay him off to sign over ownership. Really though, you have bigger problems than who owns the car. Your boyfriend is a control freak that is using the car to manipulate you. I am sure he planned that from the beginning. You need to find a way out of the relationship before it gets worse.

    get rid of this bum! But you won't, you'll stay and let him run your life. If he is doing this to you now, just imagine what marriage would be like. He's a control freak!

    If the title to the car is stated like this: Jane Doe and John Doe, then both of you are required to make any changes to the title, such as selling the car. But if the title reads: Jane Doe or John Doe, then you can legally make decisions about the car without his signature or approval.

    Who is making the payments? You should be making the payments, and if you can't then give him the car and get rid of him. If you can make the payments then tell him you would like to assume the loan and take his name off the title.

    Is your question about the car or the relationship?

    As far as the car goes, if you are both registered owners, it is just as much yours as it is his. He screwed himself by taking out a loan and then putting you on the title.

    As far as the relationship goes, it sounds like you are both pretty immature. Anyone that threatens to take things away when confronted with an argument doesn't need to be in any relationship.

    NO he can't since the car is registered in your name, and IF the title is in your name, it's yours (however, if the title is not in your name, then it's not your car technically). i don't think the financing has anything to do with ownership, and it seems to me it would be HIS choice to finance the car.

    He seems to have abandonment issues -- he wants you to leave every time you argue. He probably does this so you won't initiate this sort of separation FIRST.

    If you and your boyfriend continually have these problems, but you want to work it out, consider marriage counseling or buy a book on communicating in a relationship. There are better ways to solve problems....

    You both own the car.

    In court he could argue it's his because he makes the payments on the loan. Then all you would have to do is prove it's a gift -- which is pretty simple since he put your as primary owner and himself as only co owner.

    Anyway, fact is you both own the car. He can't take it away from you and you can't forbid him from driving it.

    It is your car, he cant take it away, but it is a way to try to control you. possession is 9/10ths of the law. If you leave it there being he is a co owner it would be his. next time take the car and the paper work don't let a man control you!!!!

    Then when he wants to make up, have him give you the car. Tell him this is not a negotiation you don't like being manipulated with the car, everytime you are fighting. Legally no he can not, you would have to sign off on the car. You can even report it stolen.

    if the vehicle is under both your names then either of you can have the vehicle. for example, if he takes the vehicle , you can take it back and vice versa. That's the way it is in the state of Texas anyway...I would call your police department and ask advice. They will be able to tell you what your rights are.
