what are the ny puppy lemon laws?

I bought a puppy from a private kennel in brooklyn ny. She turned out to have parvo and now she has been in the pet hospital for the last few days and its not looking good. The kennel said that they will see what they can do as far as the vet bill being that i did not take the puppy to the vet of their choose. to be honest i did not trust their vet or now them for that matter. I read many reviews of this jennel that were not good and unfortunalty it was after i bought the puppy. My question is if my puppy dies or is needed to be put down what happens. Is this kennel responsible for the vet bill as well as cost of puppy? please help. If u know a numer or someone i can talk to who know about this please let me know. I want to look into shutting them down. I read many awful stories about this bulldognyc in brooklyn kennel. thank you

    Since the number of pet sales necessary to fall within the definition of a "pet dealer" is fairly low, a lot of hobby breeders in N.Y. will have to know this Law. This Law does apply to both cats and dogs.

    Pros: effects only very active hobby breeders

    Cons: covering veterinary expenses for diagnostic tests might double the obligation for the seller.

    * Applies to: pet dealer (any one who engages in the sale of more than 9 animals per year).

    * Contagious or Infectious Disease: 14 days

    * Congenital or Hereditary Defects: 14 days

    * Failure to Produced Advertised Registration Papers: no

    * Replacement: yes plus the cost of veterinary fees to certify the dog as unfit for purchase up to the purchase price of the dog.

    * Refund: yes plus the cost of veterinary fees to certify the dog as unfit for purchase up to the purchase price of the dog.

    * Reimbursement of Veterinary Expenses to Treat Dog: yes, up to the purchase price of the dog.

    Every pet dealer in New York who sells an animal to a consumer shall post a notice clearly visible to the consumer and provide the consumer at the time of sale with a written notice, printed or typed, setting forth the rights provided under this article. Such notices shall be prescribed by the commissioner, but the written notice may be contained in a written contract, an animal history certificate or separate document, provided such notices are in ten-point boldface type.

    http://www.bulldogsnyc.com/ Assuming you mean these guys nothing in their POS guarantee says anything about having to use their vet. The next time you talk to them, let them know that you are contemplating taking them to small claims court.

    BTW the fact that they can't spell TERRIER should have been a clue that these weren't people to do business with.

    That's why you should always thoroughly check out a kennel BEFORE you buy.

    But, that aside, should the pup not make it (or even if it does survive) the kennel is responsible for all the bills you incur, provided the vet can attest that the puppy was infected or exposed to the Parvo BEFORE you bought it.

    If that is the case, the kennel is responsible regardless of whether you took it to their vet or not. However, since they don't sound reputable, you will probably have to take them to court to recoup your losses.

    I do hope the pup makes it - but whatever you do - document everything and get paperwork from the vet as to when the dog got the Parvo.

    ADD; If the dog makes it, you are only entitled to the vet expenses if you want to keep the dog. However, if the dog dies, :-( you will be entitled to the cost of the dog and the vet bills.

    Take the lady and the Kennel to small claims court.For $35 you can file a complaint and recieve up to $5,000 back..You d/n need a lawyer,just make sure you have all the paper work from her and the Vet and all your bills.I'm sure the court will have something to give you that shows what is necessary to bring..

    You are out of luck unless you have a contract from the breeder that includes a health guarantee.
