Can a solicitor demand an over payment nearly ten months after a case was resolved and no prior correspondence has been received regarding this?

Yes, (s)he can demand payment and can even sue for it. This is a contract debt and the time limit for making a valid claim is six years in England/Wales.

As a demand for payment has now been given, the next thing to be careful of is interest being added on to the original sum. Solicitors tend to know about that - and it's perfectly legal.

I'm not 100% on this one, but I believe if they haven't closed the file officially through the right mediums, then they can still demand payment, however, to be sure, get in contact with the Law Society on 020 72421222. Sometimes, it's just a case of the Solicitor being very lazy and not dealing with the bureaucratic side of the case.
