sent in SORN but our car has been clamped... help?
We bought a new car and sent in the SORN for the old one but it is outside our door as we are waiting for a buyer, we have no driveway and no garden so outside is where our cars are kept. The car has not been driven but they came and clamped it this morning.... i am furious we dont have a V11 so we are unable to tax the car within 24 hours and the price is due to rise to £200 for the release plus a further £150 to guarantee we can tax it - if we have not drivent he car surely the law hasnt been broken as we have no where to store this car - what were we supposed to do we live in the city so where on earth are you supposed to leave your car when you dont have a drive way - this is discrimination against anyone who does not have a drive way i think it is a disgrace and as we always do everything by the book i am furious... Any help or guidance would be nice thanks

Sorry but what is it about "OFF ROAD" as in Statutory OFF ROAD notification" that you did not understand.
If it is on the road it HAS to be taxed. If it is SORN'd then it HAS to be off road.
If you have no-where to store it then don't sorn it. While you are on the road taking up space then you have to pay, simple really.

This s not discrimination against people who don't have driveways.
The law says that any vehicle on the road must be taxed, have insurance and have a current MOT certificate.
You could have made arrangements to have the car stored at a garage, it would have cost you less in the long run.
If you do not pay the fine, your car will be taken away and crushed.
As people have said, and it states clearly on the form you filled in, SORN stands for Statutory Off Road Notice,which means you stated that the vehicle would not be parked on the road.
Section 3 of the SPORN form you signd informs you......
3 What Your Declaration Means
• That the vehicle will not be used or parked on a public road from the date given above, until a licence has been received.
• That you have checked the information provided on this form and that you believe it is correct.
Note: Making a false declaration is an offence for which the maximum fine is £5,000 and imprisonment.
Sorry but you will have to pay up.

If the car is SORN it has to be kept off road and not in a public place.
The O and R mean Off and Road.
This is not discrimination just a rule that everyone mostly knows - no tax then not on road.
You have broken the law as you have had a car on the highway with no tax - driven or not.
There is absolutely nothing you can do and if you leave it too long they will take it away and crush it.
You do not need a V11 to tax a car if you have the V5C, MOT and insurance for it so no excuse for you there anyway
Ignorance is no defence against any law
I am so pleased that the DVLA take this action now - oh as well as this they will be checking that it is insured if you do not tax it and will come after you for that as well if it is not.

Hold on, you SORNed the car - Statutory OFF ROAD Notification! Note, 'Off Road'.
It is nor discrimination against you as a city dweller. In fact, if you think about it, these laws make it possible for you to park your car! Without them your streets would be full of un-moving, untaxed cars taking parking spaces you badly need.
What you have to do, when changing cars, is either sell your present one before you get another or keep the original taxed. (You can add the value of the remaining tax on top of the sale price).

Oh, come on, anyone with even a touch of common sense knows that a sorn car has to be completely 'off road'.

Im afraid you will have to pay, the street is still a public road and you pay tax for that, you kept the car on a public road so you ahve to pay it.

Unfortunately there is not much you can do. It clearly states on the SORN that the vehicle has to be off road.

You're liable, so pay up.
'SORN' stands for Statutory OFF ROAD notification - the clue's in the name.... It's not the DVLA's fault that you don't have anywhere to park, and it doesn't absolve you of your responsibilities to maintain the correct road tax.
