Why would I support the birthers?

Ithink the birther cases should go all the way top the supreme court, but not for the reason birthers do. I want the court to weigh in on 2 constitutional questions:

1- who inforces the elegibility requirements for federal office? If a guy is not a natural US citizen (think The Governator), who tells him no? Is it the state Secretaries of State? The Congress? if a 20 year old wants to run for congress, who has standing to object?

2- if a president is later found ineligible, does it invalidate just him or does it cancel the TICKET since they run as a package deal?

I think these questions need to be answered, since they are not spelled out in the Constitution. Thus I supprot those suing to see Obama's birth certificate as a means of getting those answers. Is that reasonable?

Update:

A couple of things I would like to comment on.

1- Brown and Ryan, I would appreciate it if you read the entire question and comment on the question, not insult people because they have a different opinion.

2- Just Plain American, a Birther is someone that holds the contention that Obama was not born in the US. It has been pretty widely used in the media. And yes, it is used as an insult, rather frequently. As for suing the president, you are incorrect. A private citizen can name the president in a lawsuit.

3- Iwalk, I find your accusation of racism insulting. You do not know me and have no idea what kind of a person I am nor what my racial background is. I find it disconcerting that just because someone is opposed to Obama or says anything that could be seen as opposing him, they are automatically called a racist. Either comment on the question and provide a reasoned response, your keep YOUR hate to yourself.

    1. Congress had the opportunity to raise the issue before they accepted the vote of the Electoral College. Congress's options are laid out in the Constitution. (Amendment 12, 20)

    2. If a president is found ineligible after the Congress has accepted the results and the president has been sworn in, the only mechanism for removal is Impeachment and Trial. The rules of succession govern what happens next. (If the VP is impeached, it's the next in line, etc.)

    Each party qualifies their candidates, each state qualifies their elections and sets the rules for electors.

    ADDED: Stay-on T, where in the constitution is a special election mentioned? The procedure is governed by the Constitution and the Presidential Succession Act.

    It would be a valid question for the courts except for the nutjob birthers who actually BELIEVE that Obama wasn't born here. And the harm it would do to Obama's political agenda to have this case going on.

    So I recommend that you hold off until after Obama's second term, then get the questions answered(unless of course part of your goal is to obstruct Obama's presidency.). Although i don't think your question number two is relevant, the questions on standing and enforcement are.

    For that matter, did we ever resolve after Andrew Jackson and the Indian resettlements who has standing to enforce decisions of the court if the President decides to ignore the rulings? FDR's putting the Japanes in camps was found unconstitutional but Bush went ahead and put people into Guantanamo, this was a variation not the same but still questionable, yes?

    Who was suppose to check Obama's eligibility was the Electoral College. The DNC should have had this on their check list. Its my belief that if they were not aware of the possibility he was not natural born they knew about it before the election but after they nominated him. Philip Berg brought this up to their (DNC) attention a month before the election in a lawsuit and Philip Berg referred to this as the "October surprise"

    2. If or when Obama is removed (likely he will resign if he's about to be removed) Joe Biden will be president for 2 months till a new election is held. TWO MONTHS!!!! Wow thats kinda fast. But that's how its suppose to be done as written in the constitution.

    What is a "birther" is that supposed to be an insult or something.

    You wouldn't have been born without being birthed first. Someone had to give you birth.

    The only person who can sue a president is congress.

    I think it is reasonable. Liberals think that anyone who believes in the birthers is racist, which is not the truth. They are real people who want real answers. Although I don't really care that much about where Obama was born or if he is eligible to be our president, I understand where you're coming from.

    birthers are not really interested in learning anything about constitutional law or the meanings of these laws. This is just another avenue to express their RACISM under the guise of patriotism.
