Is there really a charge called loitering with the intent to buy drugs?

The police was caught red handed beating this guy up for standing at a crosswalk. They told him to zip up his jacket, he complied, then they beat the crap out of him and charged him with loitering with the intent of buying drugs. Is that a real charge? How can you be certain that someone is really just standing around waiting on the dope-man? Is that a felony or a misdemeanor?

    Is it a crime? I think it can be, but probably not a crime in every place.

    It's probably a pretty hard charge to prove. Maybe you could show that they were hanging around an area known for selling drugs, that they had a lot of cash on them, that they had contacted a guy who sold drugs recently, that they were asking passers by whether they could sell him any drugs.

    All in all, it's a bit hard to prove beyond a reasonable doubt without some really good evidence,

    Loitering is a misdemeanor offense. Intent would be impossible to prove, although a judge may factor loitering in a high drug traffic area into the sentencing. I believe the official charge will just be loitering.
