Should i still have to pay child support?

Question

There is no right or wrong answer here. I'm just looking for common sense responses. This child (woman) is now 19 yrs old. She graduated high school in may 2008. According to Missouri law she is required to advise of her intent of schooling. By no later than Oct following high school graduation she was supposed to send an official transcript and i never received anything. In March 2009 i find out she is attending college and her GPA is 1.16. All during this time she was not working and had the time to achieve academic performance and failed to do so. In addition she has only signed up for tech school classes that only take one semester and failed that. She attended summer 2008 and fall 2008 and could not pass the classes. Now she has gone to another school program (spring 2009)and again it is for a tech class. She has not taken one single class toward obtaining a degree from a college (classes that are of required not elective). We advised the child support agency and had to get an attorney and go to court but the mother has the child support agency on her side and we could not get the support stopped. Actually the law says if the child does not provide the paper work such as an official transcript the child support can end, but it didn't. Why does this law exist if the courts won't support it? Also she refuses to work, and ended her association with the air force (was to go to boot camp in Oct 2009. I do believe this is just a way to stay home and not have to work, live with her mom and have free money ($500.00 per month child support).

Update:

All of the child support if up to date as of dec 2008. The law in Missouri says if the child goes to continuing school you have to pay-but don't they have to pass these classes and make an attempt to become part of the working society.

Did you actually go to court, or rely on a decision by child support enforcement?  I got the requirements included in the law in 1989.  I'm in KCMO.

I have a 19 year old that is in college.  I would ask her father for help if I needed it but not make it required.  My daughter helps herself by working.  She pays her own car note and insurance and buys everything she needs without asking me for any money.  I do pay for her college and rooming but other than that she does for herself.  She is considered an adult by law.  By the way my daughter's father passed away 6 years ago and they cut off her social security servivors benefits at 18 college or not so if the government don't help after they turn 18 so why should you be required to.  If your daughter were doing well in school if figure you would want to help her and if she was working and trying to help herself it would be different but it sounds to me like she is using college to keep from having to work.  I am a woman and I think that dads get the short end some times on this child support stuff.  Some moms do too though by not getting any help from the childs father.  Anyway I think that you should not have to pay child support for a child that is not trying in school.

The first thing would be to find a attorney that specialize in this type of law, it is obvious this one has no idea.
I can bet he took your money, has he provided you with copy's of the law that you mentioned, and give you some guidance.

i don't think of a guy in this earth who's against abortion must be for an choose out regulation. i think a number of them rather do purely care approximately themselves. i think of the form of ingredient might make people pay by way of fact they have morals. i think the entire u . s . a . is going in that swing. i'm against abortion (except its rape or extreme scientific motives) and choose out. making a regulation like that is against maximum of of the girls people who morally could not stay with the call of having an abortion. Many fems have faith interior the superb yet say they does not have one themselves. faster or later adult men gets this superb and that's probably going one in each and every of the numerous reason that i'm not a feminist. i don't have faith they are finding on the entire image whilst it is composed of girls people and adult men in this situation. Feminist desire to push their weight around in this and its going to result each and every lady, not purely the feminists. Oh oops and NO it does not decrease the cost of fathers greater. it would in all probability enhance it. Many single mothers understand the cost of a father. Many toddlers do besides. See what share lady will comprehend after a regulation like that got here into play.

You may have to pay two more years, till she's 21. It may be that since the child support office knows she's failing and not working they think your money is still essential to your daughter's development and education depending on the financial situation of the mother.

I've always been under then impression that once the child turned 18 it was your choice whether you continued to pay or not. Unless of course it's back child support that you didn't pay when she was younger.... in which case there's no way out of it til your caught up...

you need to get an attorney and have him figure it out because it is the law  they have to follow it. however your attorney can make them provide a transcript and if they don't that will be grounds for termination. plus if she don't you maybe able to get all the money  you paid back.

If you don't like it you could stop paying and get thrown into jail. 

Fighting this will only make you look cheap, it'll cost you more, and you'll STILL probably lose. 

But if you think it's worth it. Then by all means, fight away.

not to be out of line here but she is your child to no???  did you not try to help raise her with morals and such so that she would get a job and education to help better herself rather than mooch off someone else??
