Can i be let go when my doctor gave me a no work slip for 3 months?

if they had honored my doctors order for light duty, no lifting or brnding..i would not have needed the surgery

Update:

my surgen told me i need to be out of work for 3 months at least...my employer will only honor the fmla which is only 60 days...was told if i do not go back to work by the 17th, the 60 days, I will be replaced. is this right?

    You have asked this question 4 times in the last 2 hours. Call a lawyer and ask him.

    The doctor is not your boss, nor is he the boss of your boss. There are some laws on this (FMLA for example), but since you really can't give all the details needed on here, you should really talk to a lawyer.

    FMLA is 12 weeks of unpaid leave. 12 weeks also comes out to 60 working days (typical work week is 5 days, times 12 weeks comes up to 60 work days). There are also some exceptions to FMLA, and some companies/industries that don't need to abide by FMLA. Again, there are no details that you gave, so it's very difficult to answer accurately. There are also state laws that could apply. Contact a lawyer for all the information you need.

    In a nutshell, contact a lawyer to see if they have violated any laws, and if you can be compensated for it.

    he could probably prove his case and especially in this economy when he is probably short handed and needs the work to be done, and if the company works in a state that has work at will laws then he could let you go for no reason at all and could not get sued. Again, go see that chiropractor and show the x-rays but say you're not seeing a doctor at the moment (or they won't work on you).

    If you live in a right-to-work state, they can fire you for any reason.
