I have a question about obtaining a visa for the USA?

Ok, this is rather complicated, and I'm not educated enough in this area to understand much.

Ok, I am an American citizen. My fiance is from Germany. He is planning on visiting me in California for a few months. Ok, so I was curious about a couple things here:

1) Does he need to get a visa if we get legally married in the USA?

2) Also how would someone get cititzenship in the US? How does this work out if we get married in America?

Thank you!

As stated before, he can enter without a visa under the Visa Waiver Program. But, he cannot adjust his immigration status while in the U.S. If he got a B1/B2 visa (business/pleasure) you would be able to file a petition for him while he is in the U.S., and he could stay until there is a determination. Keep in mind one cannot have prior intent before they enter as a B1/B2. You can get married, but he still has to leave once his I-94 expires. He'll have 90 days to visit. There is a visa called the K-1. It is a Fiance visa. You would have to get married, I believe within 6 months of him entering, and then he would be given a conditional status immigrant visa called CR1. After 2 years of marriage you apply to have the conditions removed and then he will become a lawful permanent resident. Start by going to uscis.gov and filling out an I-130 form and send that in. It takes ALONG time. Once there is a determination you will receive a form called I-797 Notice of Action. The I-797 states what the determination is. Then you go from there.

To get citizenship, one has to be a lawful permanent resident for 5 years. After that one can apply for citizenship. If eligible, one will take numerous tests involving basic English, American History etc. After that they are sworn in as U.S. Citizens.

    Good luck.

    1. He can visit you on the visa waiver

If you get married he still has to leave

You must do it properly to get him his green card and 3 years later his citizenship

read this site for the process
