Help!! Horse trouble!!?
Okay, here's the story!
A family friend was looking for a new home for his 10yo OTTB. We found someone to take the horse, who is known around the area for their schooling business (which gets good reviews for none violent training). Fabulous outcome, we thought.
The horse was taken to their place today (which was supposed to be a lovely yard with a 6 acres of lush grazing). Turned out it was an acre of sparse poor grassland, fenced with barbed wire. The stable "prepared" for the horse had no clean bedding, just a sprinkling of dirty straw on the floor. The owner (who is 70yo) asked what he would be fed to which the girl replied "oh they don't get fed! just grass and hay!". The owner is heartbroken and did not know what to do, so he left in distress. Anyway, he understandably can't leave the horse there so he's going to pick him up tommorow to bring him to my yard. We are concerned that the people will not let him take the horse - what will happen? The owner has the passport and nothing was signed, no money was exchanged as the horse was being given away.
Can they do anything to stop him collecting the horse?
hi sorry didn't make it clear, the owner (or previous owner whatever you want to call it) has the passport, not the people who have the horse at the minute

uncle stevie - I clearly stated in the question that the horse was not mine, everyone else picked that up so I can only assume that you are illiterate, in which case you should not be on this forum.

I would call the RSPCA and tell them what has happened and perhaps they can intervene or suggest what to do about it.
I realise the owner is old, but really, if he or she was giving the horse away he should have checked out the accommodation and conditions before giving the horse to this person, or sent someone along, like yourself.
It does go to show that you should never go by word of mouth, but check things out that it is for real. I was so sick when my mother let my horse go, several times to "nice people" for him to come home either so overweight he could barely move (with laminitis) or covered in spur marks and a sore mouth and back due to the "rider" having such a loose seat and who thought that spurs were smart! The best time he had away was when he went as a working livery to one of the best BHS examination centres in the area. At least then he came back fit and healthy.
I think the fact that the owner has the passport still is going to help. If they get stroppy, I think he should go to the Police and ask for back up. He is still the legal owner of the horse, especially as nothing was signed and no money changed hands. This sudden change in the horse's diet is not going to do him any good. As I am sure you know, increase or decrease in feed needs to be made gradually, not pulling the plug over night.
I do hope you get the horse back and perhaps sell him if the owner cannot keep him - checking out his new home first!

hmm rubbish situation for the poor chap. obviously being in possession of a horses passport does not prove ownership but it sure helps if their is a dispute. if there has been no money handed over and nothing has been signed it should be a clear cut case as there is no proof of sale etcetc. if you go to pick the horse up tomorrow and they wont let you take it call the police and get an officer to go along with you. lie if you have too, say they are threatening etc etc. dont mention that he gave the horse away just say he put it there on livery and wasnt happy with the service they provided. like i said a passport is not proof of ownership but the fact this chap has his name on the passport will certainly make life easier if the yard people do cause a problem. goodluck

OMG! Do not leave this horse there even over night doesnt sound safe at all should never of unloaded that horse in the first place no they can not stop owner from picking up the horse at all any problems call the sheriff to come and watch while you load your horse go asap to get the horse before something happens like running into barb wire and tearing itself to pieces horses are fright animals and in a strange unsafe place this can be tragic...

your friend should have checked out where their horse was going. hear say is not always true.
that aside.. i don't think they could stop him from going for the horse if he has the passport. i probably would speak to someone legal just to check it out.
why did he leave it there?
uncle stevie......even if he did get a bill for livery, it would only be for 1 night. so it isn't going to be a huge bill, they don't feed so no extra there.

HI First you two should have viewed this yard , and none of this would have happen bigger fools you two, but it has so go an get your horse back, but you might have a fight on your hands because they may use the trespass rule and if they do you will have to leave the horse where it is and leave the yard, you will have to go and speak to the police and get there help to remove this horse--bust of luck---yours--
hi Midnight you did say WE FOUND SOMEONE TO TAKE THE HORSE and FABULOUS OUTCOME WE THOUGHT which means two people.i only answer the question as read--yours-----
OH by the way your friend will no doubt get a nice big bill drop-ed in his hand for the horses keep while at the yard which he will have to pay before he moves the horse, so your friend could have big problems a head of him. And no i am not being RUDE i tell you how i think it is like or not.

Nope, if he has the passport and papers, the horse is his. They can call the police, but obviously the police will look at the passport and papers, and won't interfere with the horse's removal.

God that's awful
Well if i was your friend i would go there and argue intill i was blue in the face untill i got my horse! nothing was legally agreed like a signuture so I think your fine just go get the poor horse it's probly distressed in those poor conditions.

If nothing was signed and no money was exchanged, I don't see how they can stop your friend from collecting the horse. They might try, but that doesn't mean they will be successful.

could your friend phone the guy up and say he cant bear to be without his horse .and that she is heart broken....give a sob story...and hopefully the guy will have a heart and say he can have him back???
bit tricky to just say you want him back as he now has passport etc...but the sob story might work...sorry did you say new owner has passport or your friend has passport???
