Will Apple send me a new iPod?

I have a 1st Gen iPod Touch that I got under a year ago, so it is still under warranty. Recently, the battery life has been getting worse and worse, even with the brighness most of the way down, WiFi off, and doing everything else apple recommends. It is at the point that as soon as I take it off the charger, it dies (I am not exaggerating).

Do you think that if it gets shipped out to Apple or take it to an Apple Store, they will send me a new one (possibly 2nd or 3rd gen) or just replace the battery?

    No, they wont send you a new one, especially not a better version. They might repair it but they'll probably charge you as well.

    They will replace the battery. You paid for a 1st Gen unit, not 2nd or 3rd Gen

    They'll just replace the battery...I have a PSP 2000 and the sound woludn't work so they just gave me a new PSP 2000

    theyll replace the battery if its not to bad if its completly broke and you have a warranty theyll send you the same model

    I think they will. My dad has an iphone and it had a charging problem so he took it to the store(you have to set an appointment usually) and they gave him a new one.
