It depends on the persons policy that is insured. If they have uninsured motorist coverage, their insurance company will take care of them. Then, their insurance company will go into subrogation against the uninsured person. If the person with the insurance does not have uninsured coverage on thier policy then the insurance company will not pay for them and they will have to pay out of pocket, then in turn go and get a cival law suit against the uninsured party.

Once the insurance company determines the other driver at fault, they can go after them for reimbursement in most states. If the at fault person does not pay, it will go into collections and appear on their credit report.
