Someone filed a claim without me knowing!! HELP!?

I get a HUGE bill from my car insurance. I call to find out WHY and they say it was because of an accident that I was not in! Someone filed a claim while mine and my husband's truck was in the shop saying we hit a car and said they were my husband when this NEVER happened. they said they sent letters to us but we never got one stating rates would go up or claim info. What on earth do I do? i called the dealership and they said "We don't know. not us." and so did my insurance company! How do I get this taken care of since I or my husband hit NO ONE!?!?!

Update:

They are saying my husband called and said we hit someone but we never called anyone!

I am not sure what auto insurance you have but you better get out of that company because no insurance company..wait excuse let me rephrase that "No decent reliable smart insurance company" would pay a claim without talking to their insured first. he only way that don't contact is if you call them to make a claim and admit fault.

For example I hit a lady in a store parking lot. Not her but her car with her inside. Cops came gave us a report no tickets were issued. I went home called my insurance company and admit fault and they paid for her damages in 2 days. And that was the end of it. No more calls from them at all.

Could be the shop it was in did it..who knows. I don't know if this was a while back ago than the agent coming to check your vehicle won't help this situation. If there was enough time frame for a person to fix their vehicle than it won't hold water. Now you should find out if a police report was made. And take with your insurance company get on that phone ASAP tomorrow morning.

Hmmm, well, you can get an order for phone records from the Insurance company, they should be able to get these somehow and see what number this "person" called from to make this claim. I would say lawyer up and get some good legal advice. Hopefully your hubby really didn't hit someone and hide it. NOT that I am saying that's what happened, it could be foul play also. Hope that helps.

    You need an Attorney now!!!

I recommend that you interview at least 3 or 4 Attorneys who have successful trial experience with Automobile Accident Claims.

Hire the Attorney that you think is best.

If the insurance company failed to notify you, I would say that your insurance company is at least at fault in part.

If someone at the shop where your truck was, drove your truck and hit someone, the shop is at fault.

If this is a fraudulent insurance claim you need to file a report with your local District Attorney's Office.

    Do this immediately!!!!

call your insurance company and tell them you will produce documents that show that the car was in the shop the day of the accident and it could not happen. In addition, the insurance company should have produced a police report since it was an accident.

It sounds like someone at the garage used your information to file a claim and is committing insurance fraud. Call your insurance company and let them know what happened. You should also file charges.

your insurance should help you file a counter claim against the other party for fraud. if you have documentation that shows your vehicle was in the shop at the time of the accident. ( I would suspect that one of the workers of the shop was using the vehicle)

Call your agent to come assess your vehicle, if there is no apparent damage to your vehicle= you should be in the clear. If there is- maybe your man did hit someone and take off!
