I filed Chapter 7 bankruptcy 6.5 years ago. Can I file Chapter 13 now?
I had a business go bad due to building issues and my husband was unemployed after the close of this business for over 5 months. This economy stinks!
Okay, the reason for the first bankruptcy is an ex-husband who physically abused me and then took everything. It has nothing to do with my ability to handle my finances!

Yes. You are only prevented from filing another bankruptcy for 3 years.
Although, if you have to file bankruptcy twice in 7 years, the economy isn't really your problem, your ability to handle your finances is the real problem.
If you file again, you can bet that you won't even be able to get an ATM card for the next 7 years.

You may be able to file Chapter 7 after another six months. If you otherwise qualify go for the Chapter 13 if you can't wait. Check with an attorney as you will need on one in either case.

I would talk with an attorney. The bankruptcy rules have changed since the last time you filed.
Also, if this is your current husband's debt, he may be able to file on his own without you.
In the future, if you want to open a business, do it as a corporation. You can incorporate for as little as $250 and it makes your business separate from your personal credit.
