What charges could I press on someone who ran over my dog and killed it?

I am interested in knowing if any police out there could tell me or someone who had this happen to them. My dog was not on the side walk but was in the little gutter bit right next to the side walk sniffing the ground, ( you know the gutter bit that is the same color as the side walk and goes out about 6 inches ) when a driver hit my dog and killed him. I was standing right next to my dog when it happened and the driver stopped and gave me his info in case I needed to get in contact with him. My dog was in no way out in the black asphalt of the street and if I had taken a step to the right I would have been hit too.

So can anyone tell me what I can and should do in this situation?

@notyou311 I wish I could read as well as you and insert words like Off leash and out of control.

He was on his leash and sniffing the ground 6-7 inches from my feet...dont know where your getting this at.

Not an exaggeration but if the driver had come maybe 5 inches to the left his driver side front and rear tire would have been on the sidewalk and hit me as well.

    Like the lady said, it's a civil matter, but I don't think you could win because the Gutter part is the street and will be seen/labeled as that when you go to court.

    I'm surprised the driver did stop and give you any info, he must feel terrible about what happened, and now you want to punish him for being a good citizen (no wonder the world sucks).

    Ask the guy to get you a new dog and pay for any fees to dispose of the one he hit.

    Sorry about your dog but you probably can do nothing since the driver stopped after the incident. The driver could be sited if he did a hit and run, but in your cased he did not.

    You are at fault not the driver. You are required to have the dog on a leash and in your control at all times when he is outdoors. Blame yourself.

    It would be difficult to press charges as it is his word against yours and what can you charge for an accident.

    You could take him to civil court and get damages--he killed your dog! You can get pain and suffering for that.
