Will the suspended driver's license ticket be thrown away?

I am 18 years old. I had an incident where I drove without a license and crashed a car that was not mine about 2 years ago. The consequences were that I be on supervision and that they would give me a suspended license number. I have no driver's license, but there is a license number that has it's status as suspended. A month ago I was pulled over and received a ticket for driving on a suspended license even though I do not have a license. If I go get my license, will they throw away the ticket for suspended license in court? That's what the police officer told me, but it doesn't make sense because at the time I was pulled over, I didn't have one.

Because you do not have a license to suspend, they suspended your privilege to get a license.

The first thing you need to do is resolve the matter of the first suspension two years ago. Because your other ticket is still pending, you may be able to get a license at that time. The judge may take that into consideration and dismiss your ticket. Or, he could just suspend your license again.

No Honey they won't. They won't allow you to get your license until the suspension is lifted by the courts! You will continue to get tickets or even arrested if you continue to drive with out your license! And just because you don't have a license in your possession, which is illegal as well while it is suspended, doesn't mean you don't have a license. You have a license and you always will your privileges were revoked and and that is why it is illegal. Driving is considered a privilege and that is how they take it away for numerous reasons! I think what the officer was trying to tell you was that if you just didn't have your license in possession and you can prove you do have a license then it would be thrown out but since yours is suspended, good luck! Your best bet is going to be if the officer doesn't show to court which happens frequently where I am from and then the ticket will be thrown out but your license will continue to be suspended until the date or actions are done that was specified in your earlier court appearance! Good Luck!

How long were you suspended? Are you eligible for a license now? Different courts in different states/localities do different things. The officer is giving you a tip about your local court. If you're eligible for a driver's license now, get it and take it to court as the officer said. You may want to try to talk to him before trial to remind him what he said (or else talk to the prosecutor before your trial). He probably wouldn't have said this if you're still suspended, but he could have missed it. Also, there are certain things that must be proved to win suspended license cases, so maybe the officer realized he couldn't prove some part of his case. He may just want to bring you into compliance. Many times, that this the court's goal in cases where illegalities can be made legal relatively easy. Regardless, it can't hurt to do what the officer said and tell the judge about the exchange between you and the officer. Just be sure to do in a polite way.

If your driver's license is suspended, you need to contact your county courthouse or DMV to see why. If your state has a site where you can look up your DL status, try that.

When someone is pulled over with a suspended license in the state of FL (where I live), you are issued a ticket for driving on a suspended license. If you satisfy court requirements, and get your license reinstated, then you would only pay any court costs/fines and have the ticket taken off your driving record.

A good rule of thumb: don't drive if you are not 100% sure you are 100% legal!!

It is very doubtful that a ticket for a suspended driver's license will be 'thrown away'. I'm wondering what you mean by 'be on supervision'. Were you placed on probation? How long, and has it ended? I'm also wondering what you've done in an attempt to get your valid license in the 2 years since your incident.

The fact that you never had a drivers license won't be in your favor in court. Technically, you were caught driving without a valid license, and then again recently, cited for driving under suspension. That is *two* charges of driving on a suspended license. In my state, if a person is stopped by an officer, and is driving under suspension, there is an automatic punishment of at least one year of additional drivers license suspension, in addition to fines and court costs. This recently happened to my adult son. He had some minor outstanding traffic tickets he "forgot" to pay, and the city police flagged his license at the DMV. He was unaware he was suspended until he got stopped by a state trooper, who cited him for speeding AND driving under suspension. He paid the old fines, went to the DMV and paid the $100 reinstatement fee and licensing fee, and got his physical license back. But he shortly got a notice after he had to appear in court for driving under suspension, that he needed to turn in his license to begin the 1 year suspension penalty for being caught driving under suspension.

It's a vicious cycle. You can try to go get your license, but if you have a recent ticket for driving under suspension, you may not be able to get the physical license. Even if you do get the license, you may be asked to turn it in again shortly.

    Good luck.

I don' think a court would do that, at least not in my experience. Just because you never had a license doesn't mean the state can't suspend your driving privileges. I don't know why the officer said something like that and wrote you the ticket still.
