Can you evict a person thats not paying rent without a contract?
I have a Mobile Home and the people are not paying the rent.
There is no contract between the parties.
How do I go about getting them out legally
Can I just kick them out and have the police do it or do I have to go through the process of eviction..

You did not say where you were from but generally speaking...no you cannot kick them out. Check with your local government agency. Normally you have to process eviction paperwork and it takes some time. Here is NY the sheriffs have to kick them out - after the eviction process - which takes 3-4 months time...plus time for them to move. We were landlords and gave it up. This economy killed us...too many people stopped paying and we were out 6 months rent in most cases. It is a horror scene. If these people were good at one point...you may want to simply consider their situation. It might be cheaper for you to give them part of their deposit back just to get them out. You would have to formally evict them. You can't just kick them out if they have established residence in your mobile home. Failure to pay rent is a civil matter. The police won't get involved. Instead, go to court. Get an eviction order. If they don't obey it, have the sheriff put their belongings on the curb.

You get the sheriff and have them go to the trailer and serve them eviction notice. If they are bums, which sounds like they may be, then they might just take off. If they are spending their money on drugs they will probably move out. Just be careful about it getting trashed.

It depends on what state you are in. However, majority of the time you will need to go through eviction. Many states consider verbal agreements to be legal and binding.
