Meet Mike
Mike and Susan are married. Mike goes out with friend to movies. Susan, who is military, invites non military neighbor (military spouse) over for drinks while watching both of their respective children.
Both women get drunk, end up making out and finishes with Susan masturbating the other woman witha dildo. Susan texts husband dirty details.
Mike, hearing that the two people watching his kids are drunk and doing things like that, tells the woman(neigbor) to leave and not be there when he arrives. He gets home, and she shows up BACK at his house a few minutes later. She is raving drunk, swearing and cussing and calling dirty names. He tells her to leave 2 more times, and she swings at him. He dodges one, and then she hits him on the next one. Remember, he is sober, and she isn't. He is also holding his 15 month old kid while this is happening. He puts out his hand palm first to ward her attacks off. That's it. No other contact on his part. She leaves and threatens to call the cops.
The cops show up, arrest Mike and take him to jail on base for 7 hours and charge him with assault and battery. because a drunk, raving lunatic claims he hit her.
Mike's wife, who saw the whole thing, tells the same story as Mike.
Now, mike has an arrest(first ever) and has to go to court for assault and battery. Furthermore, he has to let Child Services in house to check on kids whenever they want.
Now, his life is marked and will have hard time holding down his current job and any meaningful current jobs.
What can he do? Does he have any legal recourse? HELP.

It is the defendant who bares the burden of proof....that's you. You have a witness yes.....is that witness credible?...according to your story, not quite. You need to contact an attorney. They won't convict you if they have no evidence that any crime has been committed...that's why you go to court. Lastly,this is not the place to get legal advice in such a situation.
One more thing. With the situation as it is, I would be welcoming child services into my home without complaint to disprove any suspicions. Inconvenient yes, but they are insuring the safety of your children that's all. Do what you need to do to clear your life of this chaos for your children. If this behavior is common for your wife while watching the children I would consider leaving the marriage or getting counseling as her actions are endangering the children. I wish the best for you and your family.

The administrative discharge isn't a punishment. Commanders can procedure any person for administrative discharge If they consider that man or woman, does no longer belong within the army. I do not know if there's a procedure to apeal an administrative discharge or no longer. Consult the bottom jag workplace.

Just because you are charged with this doesn't mean it will go on your record or you will be punished with it. In America, thankfully, we are all innocent until proven guilty.

Sorry i just don;t believe your story, I never liked civilian husbands married to wives in the military.
