Leagally should I be getting paid overtime?
I live in California and lately I've been working an eight hour shift from 3p.m to 12a.m then returning the same day to work another eight hour shift shift from 6a.m to 3p.m. This has been happening like two times a week.

Generally, if you work over 40 hours a week, you should get overtime. Working 3-midnight, and 6am-3pm doesn't qualify you for overtime unless you're working over 40 hours a week.

There are (2) types of overtime : Overtime pay starts after (8) Hours per day , Or after (40) Hours per week .

The rule is that an employee should be paid for every hour worked. Thus, if the employee exceeds the usual 40 hour work week then he/she must be paid overtime pay.

You should be paid for all hours worked more than eight in any day, which means from 12:00 am to 11:59 pm. You are also entitled to further compensation for working a split shift. Please contact me for additional details if you wish at ajbhowmik@hotmail.com
