Finishing up at a company do they have to pay me out for outstanding holidays?

I have resigned from one company and am moving on to another. I still have nine days holiday outstanding and they have a "use it or lose it" policy. As I am leaving them, do they have to pay me out for the 9 days?

    Yes. Unless you take the nine days as part of your notice period, which is also possible. You have a legal entitlement to your holidays.

    No they don't/ Your contract, like mine, specifies "use it or lose it" which is exactly what it says. Use your 9 days in during your notice period. The only way they can refuse to let you do this would be to pay you for those days as they would only be out standing due to their not letting you take them.
