Cop tried to arrest me for driving 65 in a 55?

Last night an Illinois State Police Officer pulled me over for going 65. I was driving along with other traffic at their speed. When he approached my car, he began to almost scream at me for driving recklessly and endangering my girlfriends life who was riding with me and other motorists. He kept interrupting me as I tried to speak and then proceeded to ask me to get out of my car so he could place me under arrest. At this point I asked what I was being charged with and he asked me to wait while he got into his car and came out and said he would just write me a ticket. Anything I can do in court about this rude, unprofessional Police Officer?

Challenge the traffic ticket and in court, IF he shows up, tell the judge your story and see if there's anything could be done about him.

If he doesn't show then let it go, man. I wanted to be an NYPD Homicide Det. before, but stopped dreaming as I realized that there are assholes like that in the police force.

File a formal complaint with the department for unprofessional/rude conduct. It won't get you much of anything, but it establishes a record if others have encountered the same thing. With a bad track record, the department will decide whether such an officer is an asset or liability, politically.

For arrest on a simple traffic ticket, states have various laws regarding it. In some states, for anything that warrants a ticket, you could also be arrested on the charge at the officer's discretion. No justification is necessary. (In Melissa, TX, a driver was arrested for failure to use a turn signal. No accident or anything, no obstructive behavior, just that the officer decided to arrest him rather than simply issue a ticket.)

Some states have actual laws preventing the arrest for an incident in which the maximum penalty is only a fine, which covers most moving violations. Interestingly, in Texas again, a driver CAN be arrested for any offense in lieu of a ticket EXCEPT speeding or Open Container.

It doesn't matter that other people were driving at the same speed he can only stop one person at a time and he happened to stop you. You were driving over the mandatory 55 MPH speed limit so he had every right to detain you . When a cop stops you , you should know better than to only speak when the cop is asking you a question cause you piss him off and he will throw throw book at you. Next time stick to the speed limit and be quiet and just take the ticket if you get caught speeding again. You could have made things a lot worse for yourself. I'm glad you didn't get arrested, you were lucky.

Apart from driving 65 in a 55 zone, we don't know how you were driving. You might have been weaving or tailgating or driving in some other erratic way -- which may be the reason he pulled you out from all the others going 65.

So go to court and fight it, but if he shows up, don't expect to win! What you're ticketed for ain't necessarily what he originally pulled you over for. It's just the one charge he can prove.

    Merry Christmas, dude.

If it was me i would hire a real sharp lawyer and take the lawyer and my girlfriend to court as a witness and make this cop look like a fool. You can complain all you want but that won't do any good .. This cop will get his in the end anyway .Karma has a way of going around . What you want to do is to be disassociated from this fkn cop.

jerk a$$ cop. I've been there so many times especially when traveling far away from the city, NYC. I just shut up because I never win, no matter my background. Stereotypes. U can file a complaint but it won;t do much as you were in the wrong so it won;t be taken seriously unless the pig, um cop, had prior complaints. (been there also). He probably dropped his donut or spilled his coffee and had a bad day. Sh!t happens. Hey, look at this way, if u were black this type of sh!t would happen all the time. I just laugh it off. I'm dark skinned Latino by the way. Merry Christmas!

File a complaint but you are not going to get out of this ticket. Driving with the traffic at their speed is no defense. You were just unlucky enough to be the one he stopped. I am sure this is not the entire story of this.

go to the nearest State Police Department and file a complaint against that officer. though i doubt anything will happen b/c of it...after all, he didn't actually do anything but scream at you and that's not illegal. and he had every right to pull you over, since you were speeding (even if everyone else was, as well)....sorry...bad news, i know. cops get away with almost anything though.

His actions do sound very unprofessional, but he didn't arrest you and all got was a ticket. I would just pay the fine and be done with it after all you were speeding.

well you can fight the ticket in court, but it seems like you actually were speeding.

If the cop just yelled at you (no assault/violating your rights) then there really isn't much else you can do.
