Hate this phone, unopened, do i still have to pay $35 restocking fee?

I got this phone for Christmas. I hate it, so I took out my sim card and put it in another phone to use. I want to get another phone instead of this one, do I still have to pay the $35 restocking fee if I didn't even use it?

by the way, i have at&t

    Yes. By law, all returned phones must be sold as refurbished so the carriers make up a part of the difference with a restocking fee.
