From which date Kuwait new labour law will be implemented?
From which date Kuwait new labour law is effective? Kuwait assembly has passed a new labour law giving 30 days annual leaves instead of 15 days. My working year will end on 15 March. Whether I will be entitled for 30 days leave? Is there any change regarding gratuity ( indemnity)? In old law 15 days salary was given as indemnity after one year. Is there any change in this figure also? And from which date this law is implementable.

the new labour law has not yet been in force. It now has to be approved by Cabinet and send to H.H. Amir of Kuwait to be signed. Thereafter it will be published in the Kuwait Official Gazette. The law will be effective from the date of publication in Kuwait Official Gazette. All these processes are estimated to be completed in another 2-3 months. It has been reported that currently all the process has been halted due to some controversies in respect of the number of official holidays.
There are conflicting reports as to whether the law will be applicable to existing contracts at the effective date. it is certain that the law will be applicable to all contracts signed after the effective date. However it is not yet clear whether the new law will apply to valid contracts signed before the date of its publication in gazette but still in force on such date.
So answer to your query relating to annual leave cannot be answered unless we know the effective date of the law and whether it applies retrospectively or retro actively.
Regarding indemnity there is considerable change in law. The major development is the provision to grant full indemnity to those resigned after completing 10 years.
