what kind of trouble can my army husband get into for cheating on me with another army person?

i have prove of him admitting that he cheated on me with her.

    Maybe you should just get a divorce and cut your losses and make sure he gives you what he owes you. There is no moral victory in trying to ruin another life. Oh, and if you get him kicked out, you will be dealing with an ex husband with no job, and that is not usually a good thing.

    The military pretty much used to look the other way with this and not bother with it unless the dependent spouse raised issues and caused problems over it with the military member and his chain of command especially if the military member continued to do a good job while messing around on the side. That attitude started to change in the mid 60s as more military personnel were married and had dependents and family problems and issues at home affected more military members and their job performance. That eventually has given way to today's attitude that such conduct is not only morally wrong but it also compromises the integrity of the military member along with all the dependent issues and high divorce rates that such behavior creates for the military. He definitely can get an Article 15 for it and if the person was military or civil service and under his chain of supervision he can even be discharged. Behavior like this if the person was in his chain of supervision compromises other aspects like performance reports and job reviews and promotions and can help facilitate fraud, waste, and abuse, and causes allot of other problems and issues for more than just him which is why the military has through the years really tightened down their approach to this and now charges and prosecutes military members for it unlike many years ago.

    The how many times or the cheating doesn't mean crap.

    the fact that he cheated and you have proof is what counts.

    Adultery is a big No-No and is usually covered under the UCMJ article 134 general . However don't let this fool you as the actual UCMJ does not cover adultery in itself. but basically like I said earlier you need proof.

    under this article he and the other offender can be brought under the Manual for Courts Martial

    so basically there are 3 "Elements of Proof" for the offense of Adultery in the Military:

    * (1) That the accused wrongfully had sexual intercourse with a certain person;

    * (2) That, at the time, the accused or the other person was married to someone else; and

    * (3) That, under the circumstances, the conduct of the accused was to the prejudice of good order and discipline in the armed forces or was of a nature to bring discredit upon the armed forces.

    If you have the prrof and willign to bring it up.

    you need to contact his chain of Command. his work office and ask to speak to his immediate Superior. Most likely a Master Sergeant, First Sergeant, Sgt Maj, Chief Warrant Officer, Lieutenant, or Captain depending on his MOS.

    I know many people in the military who have went down that road. Yes, it is against UCMJ to cheat on a spouse. However, unless you have valid proof, basically more than one eye witness, or a video of some sorts, then nothing is going to happen to him besides a slap on the wrist. Pretty much the only time I've seen the military get involved with sexual incounters is when they are rape/harassment, the rest of the time it's left alone.

    If you want to get him court-marshaled, forfeiture of pay and allowances (they give him a heafty fine) AND put into jail, go for it. You just tell his First Sergeant!

    It also depends on how he cheated and how many times.

    but if he did it with the consent of the other person and she is older than 16 than i guess our army rules dont have any punishment for him

    Read this:

    UCMJ Article. 120. RAPE AND CARNAL KNOWLEDGE

    (a) Any person subject to this chapter who commits an act of sexual intercourse with a female not his wife, by force and without consent, is guilty of rape and shall be punished by death or such other punishment as a court-martial may direct.

    (b) Any person subject to this chapter who, under circumstances not amounting to rape, commits an act of sexual intercourse with a female not his wife who has not attained the age of sixteen years, is guilty of carnal knowledge and shall be punished as a court-martial may direct.
