    Try restating your question so that it make sense to those who do not know what you are talking about.

    In matters of franchising, the sole proprietor who purchased the franchise will be "Doing Business As" (DBA) the name of the of the franchise. For all other business, it is known as the name of the profiteer's business. Example: Sample Business Co. DBA "Burger King." will file taxes and pay employees under the "Sample Business Co." name.

    Whomever registers their business name first within the state and keeps it current, has control of the name. They can franchise the name within the state or sell the rights to the business' name to any entity they choose.
